About these terms
These Terms of Service (“Terms”) are an agreement between you and Zhihui Lingyun (Hangzhou) Artificial Intelligence Technology Co., Ltd. (“Aura Cloud”, “we”, “us”). They apply to our games Bubble Fish and Tile Voyage and to this website (together, the “Services”). By playing our games or using this website you accept these Terms and our Privacy Policy. If you do not agree, please do not use the Services. AuraPOD is governed by its own service agreement, published on its website.
Who can play
You must meet Facebook's minimum age requirement (13 years old, or older where local law requires) and be allowed to use Facebook. If you are under the age of majority where you live, you need permission from a parent or guardian.
Our games are delivered through Facebook Instant Games. Your use of Facebook and Messenger is governed by Meta's Terms and policies. Meta Platforms, Inc. is not a party to these Terms, does not sponsor our games, and is not responsible for them.
Your licence
We give you a personal, non-exclusive, non-transferable, revocable licence to play our games for your own non-commercial entertainment, in line with these Terms.
Coins and virtual items
Our games contain virtual coins, boosters, skins, stars and other items. They cannot be bought with real money, have no monetary value, and cannot be sold, transferred or exchanged for money or anything of value. They are part of the game's licence, not property you own. We may adjust balances, for example to fix an error or reverse cheating, and items may be lost if a game is discontinued or removed from your account.
Ads
Our games show ads provided by Meta Audience Network. Some ads are optional and give an in-game reward when watched to the end. Rewarded ads depend on ad availability, which we do not control, so a reward may sometimes be unavailable.
Fair play
You agree not to:
- cheat, use bots or automation, or exploit bugs to gain an advantage;
- modify, decompile or reverse engineer the games, except as permitted by law;
- submit false scores or times, or interfere with leaderboards, tournaments, our servers or other players' games;
- use sharing features to send spam, or content that is unlawful, abusive or infringing.
We may remove scores, reset progress or block access if these rules are broken.
Our content
The games, their art, music, code, names and logos belong to Aura Cloud or our licensors and are protected by intellectual property laws. Except for the licence above, these Terms do not give you any rights to them.
Changes to the games
We update our games regularly and may add, change or remove features, levels or items. We may also suspend or discontinue a game; when we discontinue one, we will try to give notice in the game in advance.
Disclaimer
The Services are provided “as is” and “as available”. To the extent permitted by law, we make no warranties, express or implied, including that the Services will be uninterrupted or error-free.
Limitation of liability
To the extent permitted by law, we are not liable for indirect, incidental, special or consequential damages, or for loss of data, profits or goodwill, arising from your use of the Services. Our total liability for any claim relating to the Services is limited to the greater of the amount you paid us for them (which for our free games is zero) and RMB 100. Nothing in these Terms limits liability that cannot be limited by law, or your rights under mandatory consumer protection law.
Ending these terms
You can stop using the Services at any time and remove our games from your Facebook account. We may suspend or end your access if you break these Terms or if we are required to by law.
Governing law
These Terms are governed by the laws of the People's Republic of China, without regard to conflict-of-law rules. We will first try to resolve any dispute through friendly negotiation; if that fails, either party may bring the dispute to the competent people's court in the place where Aura Cloud is registered (Binjiang District, Hangzhou). If you are a consumer, you also keep any protection given by the mandatory laws of the country where you live.
Changes to these terms
We may update these Terms. We will post the new version on this page with a new effective date, and announce significant changes in our games or on this website before they take effect. If you keep using the Services after that, the updated Terms apply.
